Terms & Conditions
Last updated: 29 September 2026
These Terms & Conditions (“Terms”) govern your access to and use of Wittivo.com and the products, platforms, websites and services provided by Wittivo (“Wittivo”, “we”, “our” or “us”).
By accessing our website, requesting or using our services, or using an account provided through Wittivo, you agree to these Terms. If you use Wittivo on behalf of a school or other organisation, you confirm that you are authorised to act on its behalf.
1. About Wittivo
Wittivo provides technology and related services for schools and education communities. Our services may include Wittivo Campus, learning experiences, school websites, digital services, mobile applications, physical learning materials and related support or implementation services.
The specific products, features and services available to a customer may depend on the plan, proposal, order, agreement or implementation selected by that customer.
2. Eligibility and Authority
You may use Wittivo services only if you are legally able to enter into the relevant agreement or are using the service under the authority of a school, organisation, parent, guardian or other authorised party.
If you are acting for a school or organisation, you represent that you have authority to accept applicable terms and manage the organisation’s use of the services.
3. Accounts and Access
Some Wittivo services require an account. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, except where responsibility cannot legally be assigned to you.
You must provide accurate information and keep account details reasonably up to date. You should notify Wittivo promptly if you believe an account has been compromised or accessed without authorisation.
Schools are responsible for managing the users they authorise to access their Wittivo environment, including administrators, teachers, staff, parents and students, as applicable.
4. School and Customer Responsibilities
Schools and other customers using Wittivo are responsible for their own use of the services and for the information they choose to enter, upload, publish or manage through them.
Customers are responsible for:
- Ensuring authorised users have appropriate access to the services
- Providing accurate information where reasonably required to deliver the service
- Using Wittivo in accordance with applicable laws and school policies
- Obtaining appropriate permissions, notices or consents for information provided to Wittivo where required
- Managing their own school policies, academic decisions and communications
- Promptly informing Wittivo of suspected unauthorised access or security concerns
5. Wittivo Campus
Wittivo Campus is a school technology ecosystem designed to support areas such as administration, academics, attendance, fees, assessments, learning and communication.
Wittivo provides the technology and related services, but the school remains responsible for its educational, administrative and operational decisions, including the accuracy and appropriateness of information entered into the platform.
Features may evolve over time as Wittivo improves the product. Material changes affecting a contracted service will be handled in accordance with the applicable customer agreement.
6. Student and School Data
When schools use Wittivo services, they may provide information relating to students, parents, guardians, teachers, employees and school operations.
How Wittivo handles personal information is described in our Privacy Policy and, where applicable, in agreements entered into with the relevant school or organisation.
Schools are responsible for ensuring that they have appropriate authority to provide information to Wittivo and to instruct Wittivo to process that information as part of the services.
7. Acceptable Use
You must use Wittivo services responsibly. You must not use the website, platform or services to:
- Break applicable law or encourage unlawful activity
- Access another person's account or data without authorisation
- Attempt to bypass authentication, permissions or security controls
- Introduce malware, harmful code or other material intended to disrupt the service
- Interfere with the availability, integrity or performance of Wittivo systems
- Scrape, copy or extract substantial parts of the service through unauthorised automated means
- Upload content that infringes the rights of others
- Use the services to harass, threaten, exploit or harm another person
- Reverse engineer or attempt to obtain source code except where such restriction is prohibited by law
- Use Wittivo in a way that creates unreasonable security or operational risk
8. Customer Content
Customers and authorised users may submit information, documents, images, learning materials, communications and other content to Wittivo services (“Customer Content”).
As between Wittivo and the customer, the customer retains its rights in Customer Content. The customer gives Wittivo the permissions reasonably necessary to host, process, transmit, display, back up and otherwise handle Customer Content for the purpose of providing and supporting the services.
Customers are responsible for ensuring that Customer Content they provide does not unlawfully infringe another person’s rights.
9. Intellectual Property
Wittivo and its licensors retain all rights in the Wittivo brand, software, platform, website design, interfaces, technology, documentation, original content and other intellectual property supplied by Wittivo, except for Customer Content and third-party materials.
Your right to use Wittivo services is limited to the access provided under the applicable service arrangement. These Terms do not transfer ownership of Wittivo intellectual property to you.
You may not reproduce, sell, license, distribute or commercially exploit Wittivo technology or proprietary materials except with our permission or where applicable law expressly permits it.
10. Physical and Digital Learning Materials
Where Wittivo provides physical books, digital learning content or related educational materials, those materials may be subject to additional usage, licensing, ordering or delivery terms communicated at the time of purchase or implementation.
Unless otherwise agreed, purchasing or receiving a physical learning resource does not transfer ownership of associated Wittivo software, digital content or intellectual property rights.
11. Third-Party Services
Wittivo services may integrate with or link to third-party products and services. Third-party services are governed by their own terms and privacy practices.
Wittivo is not responsible for a third party’s products, availability, security or practices, although we may assist customers with integrations that form part of a Wittivo implementation.
12. Fees, Plans and Payment
Where a Wittivo service is paid, pricing, billing terms, taxes, payment schedules and any applicable renewal arrangements will be set out in the relevant proposal, order, invoice or customer agreement.
Customers agree to pay applicable charges in accordance with those agreed terms. We will not introduce a charge for a contracted service contrary to the applicable customer agreement.
13. Service Availability and Changes
We work to keep Wittivo services available and reliable, but uninterrupted or error-free operation cannot be guaranteed.
Services may occasionally be unavailable because of maintenance, updates, technical issues, third-party infrastructure, security requirements or circumstances outside our reasonable control.
We may update, improve or modify features over time. Where a material change affects a customer’s contracted service, the applicable customer agreement will govern that change.
14. Support
Support arrangements may vary according to the product, plan or customer agreement. Wittivo may provide onboarding, implementation assistance, documentation and technical support as agreed with the customer.
Customers should provide sufficient information for Wittivo to investigate technical or account-related issues.
15. Confidentiality
During a commercial relationship, Wittivo and a customer may each receive non-public information from the other. Where information is identified as confidential or would reasonably be understood to be confidential, each party should protect it and use it only for the purposes of the relevant relationship, subject to applicable agreements and law.
16. Suspension and Termination
Access to a Wittivo service may be suspended or terminated where permitted by an applicable agreement, including in circumstances involving serious misuse, security risk, non-payment of applicable charges, legal requirements or material breach of agreed terms.
Where reasonably possible and appropriate, we will seek to provide notice before suspending a customer’s service.
Termination does not affect rights or obligations that are intended to continue after termination, including applicable payment, confidentiality, intellectual property and data-handling obligations.
17. Disclaimers
Wittivo provides technology to support schools, educators, learners and families. Wittivo does not replace the professional, educational, administrative or safeguarding judgement of a school or its authorised personnel.
Except for commitments expressly made in an applicable written agreement and to the extent permitted by law, services are provided without additional warranties that are not expressly stated.
Nothing in these Terms excludes warranties, guarantees or other rights that cannot lawfully be excluded.
18. Limitation of Liability
To the extent permitted by applicable law, Wittivo will not be liable for indirect, incidental, special or consequential loss arising from use of the services where such liability may lawfully be limited.
Any additional limitations, exclusions or liability caps applicable to a school or commercial customer should be set out in the relevant customer agreement.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
19. Indemnity
Where permitted by applicable law and subject to any customer agreement, a customer may be responsible for claims arising from its unlawful use of Wittivo services, infringement caused by Customer Content, or material violation of these Terms.
Any specific indemnity obligations for commercial customers should be governed by the applicable written customer agreement.
20. Governing Terms and Disputes
If you use Wittivo under a separate proposal, order, subscription agreement, data processing agreement or other written contract, that agreement may contain additional terms. If there is a conflict, the specifically agreed commercial terms will apply to the extent of that conflict.
Applicable governing law, jurisdiction and dispute-resolution provisions may be specified in the relevant customer agreement. Until Wittivo’s final legal entity and jurisdiction details are published, this website version does not designate a specific governing-law jurisdiction.
21. Changes to These Terms
We may update these Terms as Wittivo’s services, business or legal requirements evolve.
When we make changes, we will update the Last updated date on this page. Where required or appropriate, we may provide additional notice of material changes.
Your continued use of the services after updated Terms become effective will be subject to applicable law and any separate agreement governing your use of the service.
